Credible Witnesses

Credible witnesses can be utilized when a signer lacks an identification document specified in the statute, especially when obtaining one would be challenging or unfeasible. Furthermore, the presence of a credible witness is permissible when that witness does not have a vested interest in the document or is not specifically named.

A credible witness is someone who personally knows the signer and can confirm their identity to the Notary. The witness must be able to truthfully state the following:

1. They know the signer personally.

2. The signer’s name appears on the document being notarized.

3. The signer does not have valid identification.

4. It’s difficult or impossible for the signer to obtain an acceptable ID.

5. The witness has no connection to the document — they aren’t named in it and won’t benefit from it financially.

If the witness personally knows both the signer and the Notary, only one credible witness is required.
If the witness doesn’t know the Notary, then two credible witnesses who both know the signer may be used instead.
